We have considerable franchising expertise and experience – both in contentious and non-contentious issues.

Most law firms professing to have franchising expertise principally act for franchisors or franchisees – not usually both, at least not in significant numbers.  We are one of the few firms that truly has considerable franchising experience from both sides of the fence, regularly acting for both franchisors and franchisees.  This perspective ensures that we can advise you in the best possible way and with the other party’s likely position firmly in mind, which is of considerable importance in franchising matters that have become contentious.

We are well known for our expertise and experience in resolving franchising disputes, quickly and effectively and with the most minimal of expense.  Because we see a lot of franchising matters, we are accustomed to common issues, problems and their likely solutions.

Our people have given numerous talks to franchisees and franchisors at the request of the British Franchise Association.  Our talks have focussed on areas such as intellectual property rights for franchisors and franchisees, managing and dealing with franchise disputes and guarding the franchise network.

Our team has assisted national franchisors in preparing and revising their franchise agreements to ensure they are kept current with legal changes and market practice.

  • Acting for a franchisee in a successful fraudulent misrepresentation claim through being induced to enter into a national car franchise network. Our Craig Kelly dealt with the advocacy in this High Court multi-track trial.
  • Acting for numerous national franchisors seeking urgent interim relief to restrain threatened and actual breaches of the franchise agreement, appearing in court in one instance within a day of instruction. We have never lost such an application at Court.
  • Acting for a franchisee and challenging restrictive covenants under EU Competition Law with a successful outcome.
